How much does it cost to declare bankruptcy? What are "low" bankruptcy lawyer fees? And what are overpriced? How much is the bankruptcy court filing fee? Paying too low a fee for a new lawyer who wishes to just get experience to start out is always an overpriced attorney. What you pay is cheap if the quality of the attorney's knowledge is high. You may hear a general practitioner who takes all types of cases claim that they are an "aggressive bankruptcy lawyer" and will save your home equity. Who they are being aggressive with is you; because they can't possibly hope to fully serve your interests in a complex case under the new law. Washington's homestead exemption is available only based on certain factors which are heavily influenced not only by the 2005 Bankruptcy law reform act, but the local procedural practice of the trustees and bankruptcy judges. That does not change overnight. A lawyer who only takes bankruptcy cases occassionally can't full exploit the options that are available to you to the maximun extent permissible under the law.
