The new bankruptcy act of 2005 changed many of the most important methods for determining what chapter is available to various types of potential bankruptcy petitioners. Most of the information which had accumulated regarding ch 7 or ch 14 bankruptcy law and exemptions changed without the debt law or bankruptcy law website owners knowing about it. Most were not written by or under the supervisions of a bankruptcy attorney or law firm. We have discovered that most of the information on how to file for bankruptcy available for free on the web is still outdated even as of late 2008. Thus, we risk posting our own version of FAQs online at the same time that so many other's offer contradictory or slightly different advice and statements of legal principles. It's just unfair, or a bad market to be doing honest advertising in. We are in the process of putting together a list of bankruptcy law and bankruptcy lawyer myths and truths presently out there. We have people come to us and say things like: "...but isn't it so much harder to get chapter 7 under the new law?". The answer to that is: "For whom? The means test and median income rules don't even touch at least 35% of our historical clientelle." |
